Employment Equity

1. Air Products South Africa (Pty) Ltd. (the company) recognises that certain groups of
people within our country/society have been disadvantaged in the past, and therefore they are not fully able to compete on an equal basis in employment related matters.

2. The company therefore accepts that it will proactively engage in an affirmative action
programme as detailed in the attached Employment Equity Plan. This programme is seen as
an integral component of its future business policies, strategies and business success, and is an attempt to achieve equitable representation of designated groups within its workforce

3. The company will take reasonable steps to:

3.1 attempt to achieve that the demographics of the country could be reflected approximately within the employee population over a period of time;

3.2 ensure that all employees of the company, without discrimination, will be assisted in developing their potential in an attempt to meet their legitimate expectations;

3.3 aggressively support our Values Foundation and encourage all its people to live and work by these shared values;

3.4 implement the Employment Equity Plan in compliance with the Employment Equity Act 55 of 1998 (the Act), and in such a manner that supports the total business objective of the company;

3.5 direct training and education, in greater proportion, to previously disadvantaged employees in order to assist them to compete with those who have higher potential, and comply with the Skills Development Act (97 of 1998)’;

3.6 future appointments made will comply with the attached Plan, but that suitably qualified persons appointed/promoted will fulfil all essential requirements of the positions vacant and that there will be no “token appointments” .

4. The company recognises that diversity within the profile of the workforce is desirable, as
well as the need to remedy the negative effects of the past, but within the constraints of the need to continue to operate a successful, growing business focused on the needs of all its stakeholders.

All the above will be subject to good business practices, and will be focused on the need (for all stakeholders in the company), to maintain the efficient operation of the business and to protect the safe operation within each facility by providing improved customer service and continually adding value to all interest groups within the company.
